The Elor Azaria Trial: “How can you explain to the mother whose son was killed because he didn’t shoot?”

The Elor Azaria Trial drags on with the prosecution continuing its harsh cross examination of Elor Azaria. In one exchange even the judge piled on aiding what has become the left leaning military’s judicial branch in heaping scorn onto the young soldier.

The following exchange occurred in the afternoon testimony between the military court judge and Elor Azaria:

“If the terrorist is neutralized and doesn’t constitute danger there is no need to shoot him,” said Azaria. “Even forbidden to shoot him,” added the prosecutor. Azaria responded by emphasizing: “It is forbidden to shoot him if he doesn’t constitute a danger.”

“Based on the circumstances, if you have any reasonable suspicion that the terrorists has the means to carry out an attack, you don’t see it, but you know that you suspect it, then that is enough to neutralize him. Why? Because we are taught that if there is a suspicion then you don’t wait,” he said.

“Doesn’t this phrase not mean the opposite? That is to say, when there is a doubt you are not supposed to open fire in order to avoid mistakes,” the judge interupted seemingly going after Azaria’s understanding of the terminology.

“I understand from this sentence,” Azaria replied, “that when there is a doubt, a fear that a terrorist (could strike) you neutralize him.”

Asked whether—with the knowledge of hindsight that the terrorist did not have a bomb on his body—he would have shot him, Azaria said, “I think that I acted as I was supposed to.”

“With the suspicion that I had you don’t take the risk. He could blow himself up and you would feel guilty that you did nothing about it. How can you explain to the mother whose son was killed because he didn’t shoot because he only suspected.”

“If you had known at the time that he did not have an explosive under his clothes would you have shot him?”, he was asked to which he replied: “That is the whole point, ‘if.’ I don’t know. I had two concerns in mind, an explosive and a knife. If I had known that a check had been conducted I would not have shot him in the head.”

As the trial continues most observers outside the elite section of the military and certain government quarters recognize the government’s case is not only weak but wil have ramifications on soldiers performing in fluid combat situations. Even the new defense minister Avigdor Lieberman sensing the implications of such a conclusion has demonstrated support for Azaria.

Why is the Military Court So Obsessed With Convicting Elor Azaria?

The IDF Military Courts have become populated with left leaning officers and judges. Often times these judicial “experts” that have taken great pains to create military law that hinders soldiers.  Yet, the ultimate reason for the Azaria witch hunt is the negative PR the government felt the Betzelem Video of the incident created.  Former Defense Minister Yaalon, started the witch hunt by claiming Azaria was a “radical,” and equated him to ISIS.

The fact is that most soldiers are given tremendous leeway in fluid situations in order to ensure that the soldier does not second guess to the point where it will kill him.

 

 

12 Wounded in Germany Suicide Bomb by Syrian Refugee

A 27-year-old Syrian man blew himself up at a music festival in Ansbach, Germany wounding 12 people, 3 seriously. The man detonated a an explosive device after being refused entry into the Ansbach Open music festival at around 10PM Sunday evening.

According to the Bavarian interior minister, the explosive content in the bomber’s backpack had the capability to injure and kill many more people. He also reported that the attacker came to Germany two years ago seeking asylum but his asylum claim was rejected. They claim the attacker attempted suicide twice before and spent time in a psychiatric clinic. However, the common denominator in the recent attacks in Germany is Islamic terrorism.

This is the fourth Muslim attack in Germany in the past week, including the attack in Munich that killed 9 people and injured 27 and the machete attack killing a pregnant woman. Germany has been on high alert since the recent attacks. Many German citizens are irate about the influx of Syrian refugees which seems to include a number of Islamic extremists and terrorists.

According to a poll conducted by state broadcaster ZDF, 77% of Germans fear future attacks.

Is Jewish Money Really Behind Trump’s Support of Israel?

It didn’t take long  before the anti-Israel crowd started attacking Trump and the Republicans for being too pro-Israel.  It is true, the Republican party platform is the most pro-Israel ever and with Trump’s advisors being decidedly right wing it is understandable for those used to seeing the two state solution being vaunted around all of these years assume something much more nefarious is going on.

“Candidates for high office in the US need money – lots of it. Until now Trump has been chiefly relying on his own wealth. He has raised less than $70 million, a fifth of Clinton’s war-chest.

The Republican party’s most significant donor is Sheldon Adelson, a casino magnate and close friend of Netanyahu. He has hinted that he will contribute more than $100 million to the Trump campaign if he likes what he sees.

Should Netanyahu offer implicit endorsement, as he did for Mitt Romney in the 2012 race, Christian Zionist preachers such as John Hagee will rally ten of millions of followers to Trump’s side too – and fill his coffers.”

So for CounterPunch and millions of others, Jewish money bought Trump. Somehow it is the Jews who always find a way to control the politicians.  

I would like to propose another possibility.  Donald Trump has always been pro-Israel.  Afterall, Trump is from NYC and his close friends and business colleagues are pro-Israel to farthest rightward extent. His new advisor David Friedman, is actually a long time friend and has served as Trump’s lawyer.  We can move beyond Trump’s friends and see that his son in law and daughter are Orthodox Jews.  

The only group of people that have been “hoodwinked” on this sort of thing are the anti-Israel Stormfront crowd and the far left BDS groups.  Jewish money can buy a lot of things, but Trump didn’t need it.  The Donald had already cultivated his views regarding Israel a long time ago.

Another Duma Fire: Blaming the Jews Again?

Yesterday another fire broke out in a home in the Duma village. This is the same village where an arson attack occurred a year ago and led to the arrest of two Jewish youths who were later charged for the attack. However, as many have speculated, it seems there is an internal feud between clans living in the village that may be responsible for firebombings in the last year including the one from yesterday.

The house-fire on July 31, 2015 in Duma resulted in the death of two parents and their 18-month-old child from the Dawabsha family clan. At least 6 arson attacks occurred in Duma over the last year and investigations show that the Dawabsha clan is to blame for them. A fire was reported in March but authorities said the cause was not clear.

What is clear is that Israeli authorities rushed to accuse alleged Jewish extremists in the arson attack last year. Those arrested were subject to brutal interrogation methods and were forced to admit to the arson attack. Authorities continued to arrest other Jews that were in no way affiliated with the case in Duma.

Of course, Palestinian media right away tried to put the blame of yesterday’s arson on Jews. However, all signs point to another Dawabsha clan attack. Let’s hope these blood libels against Jews don’t lead to another witch hunt against “Jewish extremists.”

Druze Security Guard Praised for Apprehending Suicide Bomb Attacker and Saving Many Lives

On Sunday morning, a Palestinian carrying a bag with explosives was apprehended by a Druze security guard at a populated Jerusalem light rail station. A security guard spotted the suspicious man, tackled him to the ground and neutralized the threat. A bomb squad arrived and detonated the bag after closing down several blocks from vehicles and pedestrians.

The terrorist, in his 20’s and from Beit Ula near Hebron, was also found carrying several pipe bombs and knives. During questioning he admitted his plan to carry out an attack on the light rail train.

Jerusalem Mayor Nir Barkat of publicly thanked the Druze security guard and his team for their heroism. “This morning, thanks to the vigilance of the light rail security guards, a large terror attack was averted,” said Barkat. The Druze people have long been considered indigenous allies of Israel and they are upstanding citizens in Israeli society, volunteering in the army and protecting its citizens.

This attack attempt is just another one in the recent terror wave which started in October 2015 as a result of incitement by the Palestinian Authority to attack Jews.

The Anti-Defamation League, Israel Policy Forum, and the Republican Party’s Platform…Is it that Bad?

The Republican party’s platform has been hailed as the most pro-Israel platform ever.  If this is the case then why does the ADL and Israel Policy Forum have such a problem with it?

David Halperin, the executive director of the Israel Policy Forum is quoted as saying the following: “It’s unfortunate because president George W. Bush was the president who really famously articulated the idea of two states living side by side in peace and security, which is the kind of baseline goal of US policy ever since.”

According to the Jerusalem Post, Jonathan Greenblatt, CEO of the Anti-Defamation League seemed to agree. “We are disappointed that the platform draft departs from longstanding support of a two-state solution to the Israeli Palestinian conflict – and the shared vision of successive American presidents and prime ministers of Israel, including the current leadership in both countries, who believed it was the only viable way to secure Israel as both a Jewish and democratic state. We hope the delegates will reconsider and reaffirm this pillar of U.S. policy toward Israel in the final platform,” Greenblatt said in a statement.

These two statements reflect what many mainstream Jewish leaders feel about America’s policy towards Israel. They have locked the two-state solution in as the only solution.  In an expression of pure Orwellian logic, anyone, breaking the two-state paradigm is deemed anti-Israel.  If this logic was true then the majority of Israelis that have decided to remove support for a two state solution are also anti-Israel.

What the Republican party platform actually does, is recognize that the facts on the ground have changed and the Israeli populace no longer supports the failed two-states for two peoples paradigm as a solution to the Israeli-Arab conflict. If anything the RNC should be praised for acknowledging the truth, not derided.

American Jewish leadership is at a cross-roads.  With Israel rising to a stature of global leadership, it no longer is as reliant on America, especially American Jews for help.  This puts self proclaimed American Jewish leaders in a tight spot. The faster they realize that a strong independent Israel means disposing of the two-state solution, there will be more of chance that these moribund organizations will remain relevant, but that kind of thinking would take a miracle.

Regavim is Battling the European Union…Again

Fresh of its successful campaign to encourage British citizens to vote for Brexit, Regavim has filed a Supreme Court appeal against Defense Minister Avigdor Liberman and the Civil Administration.  The claim is that they have not fulfilled their duty in enforcing the law. This claim tackles an outpost near the village of Hizme just North of Jerusalem.  The site is funded and built by the EU in contravention of the Oslo Accords.

Regavim has been successful in the past in forcing the government to take EU backed illegal building seriously. The EU is actively attempting to change the status quo in Area C, which is under full Israeli control.

“This non-enforcement policy strengthens the stated plan of the head of the Palestinian Authority to destroy the Bedouin outposts that are in the Maale Adumim area,” notes Regavim. “The purpose of this is to strengthen the Palestinian authority territories that are under full Israeli control and to capture the territories of strategic significance which are adjacent to major transportation arteries, and in this way to tie the hands of the State of Israel within the framework of future negotiations.”

Shabak Chief Nadav Argaman Explains the Current Terror Trend in Israel to Knesset Committee

In his first presentation before the Knesset Foreign Affairs and Defense Committee on Tuesday, the new chief of Israel’s Shabak Agency (also knows as the Shin Bet), Nadav Argaman, explained that while it seems the number of terror attacks have decreased in the last few weeks, there are still growing threats in Judea and Samaria.

Since the beginning of the terror wave which began in October 2015, there have been more than 300 “serious” terror attacks and attempts. These include approximately 180 stabbings, 90 shootings, and 30 car-ramming attacks. During this same period, security forces successfully thwarted approximately 240 serious attacks including 11 suicide bombings, 10 kidnappings and over 60 shooting attacks. Most of these attacks, explains Argaman, were carried out by Hamas.

Data provided by the Shin Bet shows that the number of attacks have been decreasing. October 2015 constituted 620 attacks (11 killed and 80 injured) while June 2016 constituted 103 attacks (5 killed and 21 injured.)

The decline in the number of attacks has been explained, in part, by the high number of attacks prevented, improvement in early warning capabilities of the security forces, and targeting suspected terrorists and their immediate family members. All this created a feeling among Palestinians in the West Bank of hopelessness in further escalation, which is also backed by public opinion polls conducted by the Palestinians.

Argaman warned that despite the decline in actual attacks, the number of threats from the West Bank is now higher than before the escalation. “This trend indicates that the situation in the West Bank today is still very volatile and adverse events (such as tensions on the Temple Mount, significant attacks, etc.) may lead to a renewed outbreak.

Regarding the Gaza Strip, Argaman said that the current calm is deceiving. Hamas is currently under political and strategic distress, so it is just a matter of time before Hamas starts shooting rockets into Israel again. While the overwhelming majority of the Gaza population is unhappy with Hamas, they are unlikely to overthrow the Hamas government due to fear of Hamas, financial dependency of Hamas, and fear of not having a better alternative. They do not want a situation where ISIS would replace Hamas.

 

Argaman also pointed out that over 40 women were involved in the recent terror wave. These women would take up arms in what can be called a suicide attack, knowing they will probably get killed as a result. Almost each of these women had internal family conflict over their sexual misconduct. They would carry out these attacks as a way to redeem themselves and as a way for their families to receive a monthly stipend from the Palestinian Authority.

The Elor Azaria Trial: A Test for Israel’s Soldiers

There is a sharp divide growing in testimony within the now widely publicized military trial of a young army soldier accused of needlessly killing a neutralized Arab terrorist in Hebron.  On one side stands his commanders who accuse him acting violently and radically in his actions.  On the other side are many supporters who believe Elor Azaria is being unjustly vilified in order to cover up for mistakes found higher up in the chain of command.

Help came today by way of surprise testimony of the army paramedic, a prosecution witness.

“Elor told me that there was a neutralized live terrorist who had a knife next to him. He said that when the terrorist moved his head and hand toward the knife, he felt threatened and shot him. I told Elor that lots of people will want to ask him about the incident. I was under the impression that he was disoriented, so I advised him to think a bit more about what to say.”

This directly contradicts the claims by Elor’s commanders and confirms initial reports that Elor Azaria was justified even while breaking orders.

The trial will have ramifications on the way soldiers deal with fluid situations in the battlefield.  One hopeful sign is that the newly appointed Defense Minister, Avigdor Lieberman has come out in support of Azaria and Lieberman’s son has donated to his defense fund. The question for the nation at the end of the day is whether soldiers will be backed up when putting their lives on the line to protect the Jewish Nation and its hold over the Land of Israel.
